    Indian non-life insurers are ramping up scrutiny and legal action against motor third-party (TP) claim fraud. A combination of organized fraudulent claims, rising court-awarded accident compensation, and a high proportion of uninsured vehicles on Indian roads is squeezing underwriting margins, threatening higher motor insurance premiums for consumers.

    1. High Court Crackdown on Fraudulent Claims

    • Special Investigation Teams (SITs): On July 29, 2026, Go Digit General Insurance secured an order from the Madras High Court directing the creation of district-level SITs across Tamil Nadu to probe widespread motor third-party fraud.

    • Scope of Scrutiny: The investigation targets staged or fake accidents, fabricated injury reports, forged insurance policies, falsified medical bills, and the conversion of non-road traffic injuries into motor accident claims.

    • Evidence & Accountability: Police have been ordered to analyze Call Detail Records (CDRs) and digital evidence, initiate criminal prosecutions against fraudsters, and take departmental action against officials who facilitate fake claims.

    2. Supreme Court Ruling Increases Insurer Liabilities

    • “Loss of Domestic Care” Head: In a landmark ruling (Shishu Pal v. Surjeet, June 2026), the Supreme Court mandated a minimum benchmark of ₹30,000 per month under a distinct head—loss of domestic care—when calculating compensation for the death of a homemaker in motor accidents.

    • Inflation Linkage: This amount is subject to a cumulative 10% increase every three years, adding to existing compensation heads (such as loss of consortium, estate, and funeral costs).

    • Higher Provisioning: The decision significantly raises potential tribunal awards, requiring insurers to hold higher claims reserves for both current and future Motor Accident Claims Tribunal (MACT) cases.
