Tax Classification Must Follow Product Form at Sale, Not End Use: Supreme Court

In a significant ruling, the Supreme Court of India has held that the classification of a product for taxation must be determined strictly by its physical form at the time of sale, rather than the manner in which a consumer may eventually use it.

Key Highlights of the Supreme Court Ruling

    • The Core Principle: A Bench comprising Justice Manmohan and Justice Arun Palli emphasized that the taxable event in sales tax law is the act of supply, and authorities are bound to look at what is supplied rather than the ultimate end use.

    • The Case Background: The ruling came while dismissing appeals filed by commercial tax authorities (including cases involving Cadila Health Care Ltd.’s “GRD Powder” and “GRD Mix”). Revenue authorities sought to tax health supplement powders under higher-rate categories as “non-alcoholic drinks and beverages” because consumers mixed them with milk or water to drink.

    • Form Over Intended Consumption: The Court affirmed that goods sold across the counter as powders or solid items cannot be artificially reclassified based on post-purchase preparation steps. Instead, items not explicitly captured by specialized tariff descriptions must fall under appropriate residuary or general entries dictated by their actual sold state.

Broader Implications for Industry & Taxation

This ruling provides crucial clarity for manufacturers and commercial taxpayers across India, curbing arbitrary reclassifications by tax authorities who attempt to levy higher rates based on consumer behavior or post-sale preparation rather than the concrete form of the commodity traded at the point of sale.
