Court Rejects Adani Plea, Rules Duty-Free Shops Subject to Domestic Laws

An Indian court has delivered a significant legal setback to the Adani Group, ruling that retail outlets operating within international duty-free areas are not immune from domestic laws and regulatory frameworks.

    Key Details of the Ruling:

    • The Core Dispute: The legal battle arose after Indian authorities flagged Adani-managed duty-free shops at Mumbai International Airport for stocking and selling nicotine pouches—a rapidly growing global nicotine product that remains unapproved for sale in India.

    • Jurisdictional Argument Rejected: The Adani Group argued that shops located in international departure zones sit beyond the country’s customs barrier and are therefore outside the reach of domestic jurisdiction. The Mumbai High Court firmly rejected this stance, stating that “such goods would be subject to the law of the land and would be governed by the regulatory regime in force even if the transaction takes place in the DFS (duty-free shops), beyond the customs barrier.”

    • Classification of Nicotine Pouches: While Adani maintained that the items do not constitute “drugs” and represent a modern innovation exempt from existing scrutiny, authorities countered that their sale constitutes a substantive violation of drug laws and poses a serious public health risk. The court noted it could not definitively classify the product at this stage, directing Adani to present its case directly to Indian drug regulators.

    Business and Strategic Implications

The ruling carries broader implications for Gautam Adani’s aviation business. The group currently manages eight major airports across India and has pursued an ambitious $11 billion expansion plan centered heavily on scaling up duty-free and commercial retail spaces to capitalize on surging air travel demand.

By confirming that domestic drug and consumer protection laws apply in full force within duty-free retail enclosures inside Indian territory, the court’s precedent could require tighter inventory compliance across the group’s airport retail operations moving forward.
