    A US Federal Court in the Eastern District of New York has officially dismissed with prejudice the criminal fraud and bribery indictment against Adani Group Chairman Gautam Adani, his nephew Sagar Adani, and former Adani Green Energy CEO Vneet Jaain.

    The ruling by US District Judge Nicholas G. Garaufis granted the Department of Justice’s (DOJ) Rule 48(a) motion, permanently closing the criminal case and preventing prosecutors from refiling the same charges in the future.

    • Permanent Dismissal: The court dropped all criminal counts, including conspiracy to commit securities fraud, conspiracy to commit wire fraud, and substantive securities fraud.

    • DOJ Rationale: Senior Justice Department officials stated the decision to drop prosecution was based on jurisdictional constraints, the primary focus on foreign (Indian) conduct, the difficulty of proof, and the absence of identified U.S. investor losses.

    • No Quid Pro Quo: Following sworn affidavits filed by Gautam Adani and defense counsel, Judge Garaufis confirmed that Adani’s earlier pledge to invest $10 billion in the U.S. economy was not a factor in the DOJ’s decision.
