Why It’s Time to Reset India’s Insurance Sector: Governance, Data, and Transparency Reforms

As the Insurance Regulatory and Development Authority of India (IRDAI) conducts a comprehensive review of its regulatory framework, industry experts point to deep-seated systemic issues. Despite generating annual revenues of approximately ₹13.4 lakh crore in FY26 (₹10 lakh crore life, ₹3.4 lakh crore non-life), the Indian insurance sector faces severe headwinds due to aggressive underpricing, high intermediary costs, governance gaps, and solvency pressures.

    Key Challenges Facing the Sector

    • The “Race to the Bottom” & Underpricing:

      • Fierce competition and aggressive marketing have led insurers to slash prices unsustainably—such as offering up to 99% discounts on standard fire portfolio rates.

      • The Reserve Bank of India’s (RBI) Financial Stability Report (June 2026) highlighted direct financial stability concerns regarding persistent non-compliance with solvency norms by three public sector undertakings, driven by underpricing and high expenses.

      • Public general insurers accumulated net losses of ₹11,400 crore in FY26 (with underwriting losses touching ₹20,267 crore), necessitating continued capital infusions despite already receiving ₹17,450 crore since FY20. Foreign insurers have also struggled, logging significant accumulated losses.

    • Flawed Intermediary Remuneration:

      • While statutory sub-limits on expenses were replaced by an overall 30% cap under the IRDAI Expenses of Management (EOM) Regulations, 2024, it failed to curb excessive intermediary payments.

      • Acquisition costs are frequently obfuscated under alternate expense heads (e.g., marketing, IT, travel) to bypass regulations, creating high concentration risks (e.g., 10 out of 462 brokers controlling 70% of the general insurance market).

    • Governance Gaps:

      • A stark disconnect exists between formal Board-approved policies filed with regulators and actual business practices, evidenced by extreme discounting and acquisition costs touching 50%–60% in certain segments.

Proposed Solutions for a Sector Reset

To build a resilient foundation for the next two decades, the author recommends the following structural reforms:

    1. Inter-Regulatory Coordination via FSDC: Leverage the Financial Stability and Development Council for seamless data sharing (e.g., the RBI tracking 10-year payment flows between regulated banks/NBFCs and insurers; SEBI cross-verifying public issue data with IRDAI).

    2. Enhanced Public Data Transparency:

      • Intermediaries: Publicly disclose payments made to intermediaries and their associates to expose market concentration.

      • Claims & Legal Disputes: Mandate transparent disclosures on portfolio-wise claim repudiations and pending litigation to measure the industry’s trust deficit.

      • Pricing & Investments: Track 10-year pricing trends on corporate property and group health, and monitor incremental (rather than gross) investments in government securities to evaluate true annual cash surpluses.

    3. Overhauling Reporting Rules: Recast the 2000 IRDAI Annual Report Furnishing of Returns Rules to capture modern distribution dynamics—including web aggregators, GST flows, and broker networks—thereby closing information gaps that allow valuation arbitrage during IPOs and private equity deals.

    4. Stricter Regulatory Enforcement: Link penalties directly to the nature and extent of violations, introduce effort-based remuneration, and enforce commission caps on specific lines like motor third-party premiums.

    Conclusion

For India’s insurance industry to meaningfully drive economic growth over the next 20 years, regulatory authorities must enforce stronger corporate governance, comprehensive public data disclosure, transparent intermediary payments, robust claims reporting, and risk-sensitive solvency standards.
