US Senate Blocks Clarity Act: Crypto Bill Fails Vote as Bitcoin Falls

The US Senate has failed to advance the Clarity Act, a comprehensive cryptocurrency bill backed by President Donald Trump, adding fresh uncertainty to the regulatory outlook for digital assets. According to a Reuters report cited in the source material, the procedural vote failed 49-50 on Tuesday, falling short of the 60 votes required to move the legislation forward.

Four Republican senators—Jerry Moran, Susan Collins, Josh Hawley and Thom Tillis—joined Democrats in voting against the measure.

Clarity Act Put on Hold After Senate Vote

The bill’s failure effectively puts the legislation on hold as Congress prepares to leave Washington this month ahead of the November midterm elections. Republicans will seek to retain control of both chambers.

Senator Thom Tillis switched his vote from yes to no in a procedural move that preserves the possibility of bringing the bill back for reconsideration.

The Clarity Act sought to establish a regulatory framework for digital assets, an approach that cryptocurrency companies have argued would provide greater legal certainty for the industry.

With the legislation stalled, attention is expected to shift toward the US Securities and Exchange Commission (SEC) and the Commodity Futures Trading Commission (CFTC), which could establish crypto-market rules using their existing authority.

What Does the Bill’s Failure Mean for Crypto Investors?

According to Shiv Ram Pande, Chief Business Officer at BitSave, the immediate impact on crypto companies and investors is likely to be limited.

Spot Bitcoin and other crypto exchange-traded funds (ETFs) will continue to trade, while banks and asset managers can continue offering custody services and crypto-backed lending, he said.

“What stays open is the question Clarity was meant to settle. Which digital assets fall under the SEC, and which fall under the CFTC, and most importantly what protections do investors get?” Pande told Mint.

He also pointed to the regulatory questions that remain relevant following the Terra-Luna and FTX collapses in 2022.

Pande said the failure of Congress to pass the legislation could encourage the SEC and CFTC to establish rules independently. While this could offer near-term clarity, rules created through regulatory action may be easier to revise following a change in administration than legislation, potentially affecting institutions with long-term investment horizons.

What Does the US Crypto Bill Setback Mean for India?

The US regulatory setback has no direct impact on Indian crypto investors or platforms, Pande said, as they continue to operate under India’s existing regulatory framework.

India’s current tax treatment, including a 30% tax on crypto gains and 1% TDS on transfers, remains unchanged, according to the supplied source.

However, the indirect impact could be significant because India loses a potential reference point for crypto regulation.

“A US market-structure law would have been a tested template for classifying digital assets and splitting oversight between regulators,” Pande said.

He added that Bitcoin is priced globally, meaning volatility in US crypto markets can reach Indian investors on the same day.

Crypto Markets React to Clarity Act Vote

Bitcoin declined from approximately $78,000 before the vote to around $76,000 in the latest update provided in the source material.

According to Reuters, Bitcoin had fallen more than 5% as the Senate vote appeared headed for failure, marking its biggest one-day percentage decline since June.

Shares of cryptocurrency exchange Coinbase and stablecoin issuer Circle also fell by as much as 10%.

Why the Clarity Act Mattered to Trump and the Crypto Industry

The cryptocurrency industry reportedly spent hundreds of millions of dollars campaigning for the legislation, which aimed to create a regulatory framework for digital assets.

President Donald Trump had urged Congress to pass the bill after seeking support from the crypto industry during his 2024 presidential campaign and describing himself as a “crypto president.”

The source material also states that Trump has earned more than $1.4 billion from his family’s crypto ventures.

Federal Reserve Interest-Rate Decision in Focus

Markets are also awaiting the US Federal Reserve’s interest-rate decision, scheduled for 11:30 pm IST on Wednesday, according to the supplied report.

The source says markets have largely priced in a rate hike aimed at curbing inflation. Higher interest rates can weigh on risk assets, including cryptocurrencies, by increasing the relative appeal of interest-bearing investments and tightening financial conditions.
