    Controversy Erupts Over Subhash Chandra’s Personal Insolvency Resolution Plan

    A bitter dispute has broken out within India’s banking and legal circles following the approval of media veteran Subhash Chandra’s personal insolvency resolution plan. Dissenting lenders have formally alleged that five entities tied to Chandra’s family wielded a combined 61.78% voting share to railroad the approval of a contentious settlement proposal.

    The Core of the Dispute

    Under the approved personal insolvency framework, the repayment proposal offers roughly ₹6.5 crore against staggering admitted creditor claims totaling approximately ₹22,006.57 crore.

    When the resolution plan went to a vote among 23 participating creditors, it managed to clear the threshold. However, major dissenting financial institutions—including institutional heavyweights like HDFC Bank and Canara Bank—strenuously opposed the outcome. Lenders argued that the five entities that cast the decisive 61.78% majority votes in favor of the plan are closely linked associates or related parties of Chandra’s family, and should have been legally barred from voting on the resolution.

    Implications for Personal Insolvency Frameworks

    The dissenting banks, which collectively captured a mere 19.18% vote share against the plan, contend that the voting mechanism was compromised by related-party influence. Legal experts note that the controversy underscores critical loopholes in how related-entity voting is managed under personal insolvency proceedings, setting the stage for aggressive legal challenges in higher appellate tribunals as lenders fight to contest the heavy writedown.
